American Atheists Disappointed in Kentucky Court of Appeals Ruling: Will Appeal
KENTUCKY COURT OF APPEALS RULES AGAINST AMERICAN ATHEISTS
American Atheists sued the Commonwealth of Kentucky after a law was passed requiring the Kentucky Department of Homeland Security to state that they could not protect the state without the help of "Almighty God." In addition, that sentiment was required by law to be placed in brochures, discussed and promoted at meetings with the public, and a plaque built to denote the mandated belief in the power of "Almighty God" to protect the Commonwealth.
The Franklin Circuit Court had already ruled in favor of American Atheists. The Commonwealth appealed that decision to the Kentucky Court of Appeals, who released their ruling in the morning on October 28th. The decision was 2-1 against American Atheists.
Obviously, American Atheists is disappointed in the ruling. Dave Silverman stated, "Naturally, we are disappointed in this ruling, but we are encouraged that one of the three judges on the panel agrees that using a governmental entity to endorse a specific god is illegal. We will appeal this ruling and continue this fight to protect our Constitution and the Separation of Church and State. This is not over.”
That's right! American Atheist WILL appeal this decision to the Kentucky Supreme Court using a petition for a Writ of Cretiorari. Edwin Kagin, National Legal Director for American Atheists said, “Senior Judge Shake stated it very well in her scathing dissenting opinion when she said ‘[these laws] go beyond merely acknowledging the historical role of religion and instead require dependence upon Almighty God to secure the Commonwealth’s safety.”
Mr. Kagin continued, “I wonder how the majority would have felt if the statute required reliance on Allah for the security of the Commonwealth. American Atheists will use this decision as an opportunity for a higher court to rule correctly and further avoid the move toward theocracy represented by this case. Judge Shake laid out very well the basis for the petition for a Writ of Certiorari.”

ATHEIST ACTIVIST GROUP DISAPPOINTED IN KENTUCKY COURT OF APPEALS RULING IN KENTUCKY HOMELAND SECURITY CASE
American Atheists expressed disappointment today that the Kentucky Court of Appeals three judge panel ruled 2-1 against American Atheists in the case against the Kentucky Department of Homeland Security for their mandate of belief in “Almighty God” to protect the state from terrorism.
American Atheists previously won at the Franklin Circuit Court. The Commonwealth of Kentucky appealed to the Kentucky Court of Appeals.
Dave Silverman, President of American Atheists stated, “Naturally, we are disappointed in this ruling, but we are encouraged that one of the three judges on the panel agrees that using a governmental entity to endorse a specific god is illegal. We will appeal this ruling and continue this fight to protect our Constitution and the Separation of Church and State. This is not over.”

Again we see that government endorsement of religion only serves to cheapen religion.”

Since the panel is made up of elected judges this is something of a victory in a state like Kentucky. I join Edwin in praising Senior Judge Shake's courageous dissent.
Yet we can already see the "overwhelming force" strategy of the theocrats. Wear down the constitutionalists' time, energy, and financial resources. Lose a thousand lawsuits - it's other people's money after all. But then raise money and elect judges who are willing to ignore certain sections of our constitution, civil law, and precedent. Do this all the way to the top. See Bush's Supreme Court apointees. Soon enough, it won't be enough for us to be correct. The judges will just smile and say "You lose because I believe in god."

My take on the situation is that we have maybe 10-20 years to get as big as the religious right so that we can offset their voting power.
I think my favorite part is where they suggest that the posting is okay because the government employee publishing the content does not have to believe in the message being posted. To my non-judicial mind this would be saying it is better to force employees to lie rather than to make sure they are not put in situations that conflict with their beliefs. Welcome to Kentucky.
Here, the Kentucky legislature made legislative findings in
KRS 39A.285(3), which references the Commonwealth being protected by
an “Almighty God” and requires such findings to be publicized in KOHS
training materials and posted at the State Emergency Center. While KRS
39G.010(2)(a) requires the executive director of the Kentucky Office of
Homeland Security to publicize these findings, no requirement exists that
the director agree with or believe in them or that citizens read the posting.
What a freakin joke. Are you kidding me? The state is required to announce and print in its literature that God's assistance is the only way these brave members of homeland security can keep us safe? Well, we are all doomed then. Where the HELL was God on Sept 11th christians? Was he on vacation? Lunch break? Oh maybe He was just too busy to get involved with a country who does not believe in his son Jesus. But wait a minute, I thought the US was head over heels for Jaysus. So that can't be it. We need God to keep us safe from terrorism? No thank you. He had his chance and failed miserably. The clear choice is to remove God and ALL religion to keep us safe from these terrorists. Wake up America, the religious right will not stop until we are a christian theocratic state. How has that worked out for the world?

Wow! Mind-boggling ... and scary! I mean, how small a step is it from that to branding non-believers as terrorists. After all, "if you're not with us, you're against us."
What a disgrace. I'd just as soon move to appeal as I would impeach the two judges ruling in favor of ignoring the first amendment because they clearly are incapable of impartial judgement and ruling.
And all that is beside the fact that "Almighty God" is why 9/11 happened to begin with. So much for relying on him.
No offense to many Kentuckians, but that state could use the help of many gods for all its problems. If their politicians were smart (they are not which is one of the reasons they need help) they should have had the statement call for Zeus, and Ra to help them as well.

1. Our country as a whole moved from a Christianity way of life to a godless nation.
2. The United States of America no longer believe family values and morals. Marriage is just a piece of paper and it's just a convenience and no longer needed with the times.
3. Our Constitution is antiquated and no longer meets today's criteria.
4. USA enemies directly and indirectly are funding organizations like ACLU, Ford Foundation, Occupy Wall Street, this organizations, and many more. What is the best way to destroy a strong nation? The creation of viruses within that country by causing turmoil, hate their own government, people, God, and overthrowing of the current system.
5. USA enemies are Russia, China, and Middle east just to mention a few those guys, they have institutions set-up here in the USA and funnel money to the anti-American citizens virus, organizations like yours, but they cannot be traced back to the enemy aka puppet master, because the money passes from different hands.
6. All organizations that fights against our way of life are unfortunately infiltrated by the enemy through citizens like you and I, but they answer to their puppeteer all the way to the puppet master which is under our noses and no one seem to notice, because we are to busy destroying USA.
7. Occupy Wall Street are strong believers of socialism therefore once they get their way the USA will change its name to United Socialist States of Amerika (USSA). The Pledge of Allegiance will be simply "Hail Socialism!" This is a godless way of life in a socialist environment. Don't worry your organization will revamp and become a different thorn on the new Amerika's side.
5. Everything goes and USSA will be the pit of the world, the new modern SODOM AND GOMORRAH, that the stench and corruption will be spread worldwide.
6. Once that socialism fails, because it is a step closer to communism Mother Russia and China will lead the United Nations to police us up to become better obedient to the new United Nation Constitution. Your organization will need to progress once again and try to fight for freedom, but in reality it will be too late because that generation will be more dumb down then this present time generation of American haters virus.

Being an atheist or a secularist doesn't equate to being socialist or communist. I find your argument kind of funny considering the Christian bible supports the idea of a socialist/communist society. The whole "sell everything you own" and "Harder for a rich man to get into heaven" thing. Matthew 19:21-24 for example and Acts 4:34-37.

Republic, the whole crux of your rant here appears to be that the totalitarian concepts of communism, socialism and islam are destroying America. People, you are all way too funny. You take a news report and turn it into a religious arguement. That's really amazing. Anyway, my post is about the article above not GOD. I will be frank, I am a christian who believes in GOD. That is my right, the bill of rights says so, but I also believe that Church and state MUST remain separate in ALL aspects of government. The reason that I personally think religion should stay out of government is because of a brutal lesson history taught us.
Let me remind you of the dark ages. After the fall of the Roman empire the only governing body left in Europe with any power was the church. The popes ruled with a iron fist and although countries had it's own king or ruler, the pope had the final say and up until the 1600's could make a monarch walk the courtyard of the Vatican in his underwear during winter. During this dark age, technology was lost and sanitation was forgotton because the CHURCH, considered ancient roman baths and inventions as pagan and evil. Also most of the Roman libraries were razed by the church when they found them intact. Only a fraction of Roman documents and information from those libraries remain intact today.
Because of this, disease and corruption ran rampant throughout all of Europe. On top of all this was the stupidity of the Inquisition. However, somewhere around the 1600's people started to think for themselves again and slowly fought the church and it's backward ways. Hence, europe slowly start to emerged from the dark ages and we have arrived at where we are today.
What does this mean? It clearly means that religion cannot effectively govern people. Only people can govern people and it should be done in a just and fair manner. So to sum it all up, religion has no place in government. The only place religion has is in the heart and mind of those who wish to believe in it.
